Terms of Service

Welcome to MyEV.com ("MyEV," "we," "us," or "our"). By accessing or using our website, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

1. Overview of Services

MyEV operates an online marketplace that connects buyers with sellers of electric vehicles (EVs). Our Services include vehicle search and browsing, personalized match scores, battery health intelligence, deal ratings, AI-assisted shopping through our virtual assistant EVa, lead routing to dealers, and related informational content.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use our Services. By using MyEV, you represent and warrant that you meet these requirements.

3. User Accounts

You may create an account to access personalized features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Vehicle Listings & Information

Vehicle listings on MyEV are provided by third-party dealers and sellers. While we strive to ensure accuracy, we do not guarantee the completeness, reliability, or accuracy of any listing information, including but not limited to pricing, vehicle specifications, availability, battery health estimates, mileage, condition, or photos.

  • Battery Health: Battery health percentages shown are estimates based on publicly available degradation models and vehicle data. They are not certified diagnostics and should not be relied upon as a substitute for a professional inspection.
  • MY Score: Our proprietary match scores are algorithmically generated for informational purposes and do not constitute a recommendation to purchase.
  • Pricing: Listed prices are set by sellers and may change without notice. Deal ratings compare against market data but do not guarantee savings.

5. No Direct Sales

MyEV is a marketplace platform — we do not sell, lease, or finance vehicles directly. All transactions are between buyers and sellers/dealers. MyEV is not a party to any vehicle purchase agreement and bears no responsibility for the completion, quality, or terms of any transaction.

6. Lead Submission & Communications

When you submit a "Check Availability" inquiry or other lead form, your contact information (name, email, phone, zip code) will be shared with the applicable dealer or seller. By submitting a lead:

  • You consent to being contacted by the dealer via email, phone, or text message regarding the vehicle and related offers.
  • You acknowledge that dealers may use prerecorded messages or autodialers.
  • Your consent is not a condition of any vehicle purchase.

7. EVa AI Assistant

EVa is an AI-powered shopping companion designed to help you find and compare EVs. EVa's responses are generated by artificial intelligence and are for informational purposes only. They do not constitute professional advice (financial, legal, mechanical, or otherwise). Always verify important information independently.

8. Prohibited Conduct

You agree not to:

  • Use automated systems (bots, scrapers, spiders) to access our Services without prior written consent.
  • Submit false, misleading, or fraudulent information in any form or inquiry.
  • Attempt to interfere with, compromise, or disrupt the operation of our Services.
  • Use our Services for any unlawful purpose.
  • Reproduce, duplicate, or exploit any portion of the Services without express written permission.

9. Intellectual Property

All content on MyEV — including text, graphics, logos, icons, images, software, the MY Score algorithm, EVa's conversational design, and the overall look and feel of the Services — is the property of MyEV or its licensors and is protected by applicable intellectual property laws. Vehicle photos and descriptions are owned by the respective sellers/dealers.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYEV AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless MyEV and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of another.

13. Modifications to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
